DMCA Policy

LegitExam respects intellectual property rights and expects its users to do the same. This policy outlines our procedures for handling copyright infringement claims under the Digital Millennium Copyright Act (17 U.S.C. § 512).

1. Designated Copyright Agent

LegitExam has designated an agent to receive notifications of claimed copyright infringement. If you believe that content on LegitExam infringes your copyright, please send written notice to our designated agent at:

We respond to all valid DMCA notices within 5 business days.

2. Requirements for a Valid Takedown Notice

To be effective under the DMCA, your written notification must include all of the following elements:

  • A physical or electronic signature of the copyright owner or authorized agent.
  • Identification of the copyrighted work(s) claimed to have been infringed. If multiple works are covered by a single notification, a representative list is sufficient.
  • Identification of the material on our platform that is claimed to be infringing, with sufficient detail (e.g., URL) for us to locate it.
  • Your contact information: name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notification is accurate, and that you are the copyright owner or authorized to act on their behalf.

Warning: Knowingly making a material misrepresentation in a DMCA notification subjects the claimant to liability for damages under 17 U.S.C. § 512(f).

3. Our Response to a Valid Notice

Upon receiving a valid DMCA takedown notice, LegitExam will:

  • Promptly remove or disable access to the allegedly infringing content.
  • Notify the user who posted the content that it has been removed and provide a copy of the takedown notice (with personal contact information redacted where appropriate).
  • Inform the user of their right to submit a counter-notification if they believe the removal was made in error.

4. Counter-Notification Procedure

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our designated agent. A valid counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located (or in any judicial district if your address is outside the U.S.), and that you will accept service of process from the person who submitted the original DMCA notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action to restrain the allegedly infringing activity, we may restore the removed content at our discretion.

5. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), LegitExam maintains a policy of terminating the accounts of users who are found to be repeat infringers of intellectual property rights. We reserve the right to disable or terminate any account that has received multiple valid DMCA notices, at our sole discretion.

6. Accommodation of Standard Technical Measures

LegitExam accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works.

7. Limitation of Liability

LegitExam is a service provider within the meaning of 17 U.S.C. § 512. We are not liable for any third-party content posted on our platform. Upon receiving a valid DMCA notice, we will act expeditiously to remove or disable access to the infringing material.
